“Heightened Scrutiny Is Real. Use It.”

speaking to state officials at the NASUAD HCBS Conference
Spokesmen for the Centers for Medicare and Medicaid Services (CMS) offered new clarification important to ADS/ADHC providers during several sessions at the National Association of States United for Aging and Disabilities (NASUAD) annual HCBS conference August 29th thru September 1st.
In short, the single word “unless” in the HCBS regulations provides the states and providers within them the opportunity to justify under the provision of heightened scrutiny continued Medicaid HCBS funding for ADS/ADHC services regardless of the physical setting as long as the person-centered, community quality requirements are met.
Although justification may be rigorous in some instances, this clarification is a significant step forward from an administration that previously seemed determined to prohibit any setting that was physically located within, on the grounds of, or next to an institution.

During this election season is the perfect time for Adult Day Centers to reach out to incumbent candidates and challengers to educate them about the services centers provide and to whom they provide them. It is also an excellent time to educate center participants about the candidates who seek to represent them in the various political offices.
If you operate as a non-profit, this can easily and effectively be done without putting at risk your charitable organization tax exempt status, provided you follow a few simple guidelines!
Through our membership in the Leadership Council of Aging Organizations, we were able to meet with professional counsel to learn which guidelines to follow.

In support of National Adult Day Services Week, the National Center for Health Statistics has released its first data from the 2014 National Study of Long Term Care Providers.
In 2014, cardiovascular disease (44%) was the most common diagnosis among adult day services center participants, while severe mental illness (10%) was the least common diagnosis. About 30% of adult day services center participants had a diagnosis of Alzheimer’s disease or other dementias; 30% had diabetes; about 25% had intellectual or developmental disability; and 25% had depression. It is estimated that 282,200 participants were enrolled in adult day services in the United States on any given day in 2014.

The Nominations Committee of the National Adult Day Services Association (NADSA) is charged with identifying the best candidates to lead the association into the future, balancing skills, experience, geography, gender, ethnicity and other factors that would result in a strong and diverse board. The membership will be responsible for approving the slate of Directors recommended by the committee, and the results will be announced at the Annual Business Meeting in Phoenix, AZ, on October 17, 2015.
All Directors of the NADSA Board must be NADSA members, and a majority must be providers of adult day services. Elected Directors take office at the close of the Annual Meeting at which their election is announced. Board Directors serve for a term of three (3) years. Directors may serve on the Board for no more than six (6) consecutive years, provided that a Director serving as an Officer in any of the Chair-Elect, Chair or Past Chair offices may continue to serve on the Board to complete the full cycle of these successive offices.
NADSA Board members are expected to participate in quarterly teleconferences and attend two in-person meetings each year—one in conjunction with the fall conference (locations vary) and one in conjunction with the spring public policy conference in D.C.
With your help, we can fulfill our charge of assuring that your National Association’s leadership is comprised of those individuals who can help to advance or mission of “advancing the national development, recognition and use of Adult Day Services.”
